HB 85 would change the valuation in which the fair market value of conservation use forest land is calculated. The proposed methodology would consist of production, sales, soil maps, market variances, zoning designation, land use plans, and account for the value of all personal property on the property. This proposed methodology shall be prescribed by the commissioner on June 1, 2019, and annually thereafter. This bill also proposes that the commissioner would be required to publish and maintain a sales data bank for forest land. If a taxpayer or a county board of tax assessors were to challenge the commissioner's methodology under this proposed legislation, they would be able to appeal to the Georgia Tax Tribunal within 30 days of the publication of such methodology.
