This legislation would waive the defense of sovereign immunity for claims involving declaratory judgment or injunctive relief against the state or any political subdivision. This waiver would not extend to situations when state law explicitly prohibits a waiver, claims for monetary relief, attorneys' fees, expenses of litigation, contracts between the government and third parties, claims alleging a violation of federal law, or claims brought in a court of the United States. Sovereign immunity, however, would be waived for all claims relating to a breach of any written contract.
