This legislation would waive the defense of sovereign immunity for claims involving declaratory judgment or injunctive relief against the state. This waiver would not extend to situations when state law explicitly prohibits a waiver, claims for monetary relief, attorneys' fees, expenses of litigation, contracts between the government and third parties, claims alleging a violation of federal law, or claims brought in a court of the United States. Additionally, the legislation would provide a right to direct appeal on rulings denying or refusing a grant of immunity.
