This legislation would require local law enforcement agencies to maintain a program whereby person desiring drug or alcohol abuse treatment or mental health treatment can get information and referrals from such local law enforcement. Furthermore, the legislation would require local law enforcement agencies to adopt written policies setting forth how the agency will comply with this state law, including compliance with providing information, providing referrals, identifying persons with drug or alcohol problems, and providing technical assistance. Additionally, the legislation would prohibit any such person who contacts law enforcement in good faith from being arrested solely from seeking such information or assistance. Finally, the legislation woiudl require all prosecuting attorneys to create written guidelines for the implementation of state law that prohibits and arrest and prosecution of any such person seeking help.
