This legislation would grant municipalities the same level of sovereign immunity as counties. Currently, Georgia cities have a lower level of sovereign immunity than counties which can cause a city to face liabilities that a county does not face, particularly when a municipality enters into a joint project with a county. The legislation would also ensure that a city does not waive its immunity to the levels of insurance when entered into a joint project with a county unless the county has also waived its immunity. Finally, the legislation would also ensure that the ante litem notice, which is the notice required to be sent to a city before anyone files a lawsuit, would apply to any claims under this proposed legislation.
