HB 329 as amended would lower the top end of the State Income Tax from 6% to 5.4%, and keep the graduated rates. However, HB 61 (E-Fairness) has been added to this bill. The language that would establish an economic nexus remains in place. This legislation would require "delivery retailers" that have a gross revenue in excess of $250,000.00 or conducts 200 or more retail sales in the State to collect and remit sales and use taxes. The bill also outlines the procedure for remission, and penalties for non-compliance.
