This legislation would prohibit judges from mandating the release of an accused on an unsecured judicial release before appearing before a judge except when the crime accused of provides for no confinement or the offense is for providing alcohol to a minor. The would only include having a secured release, meaning posting a cash bond, posting a bond via a professional bondsman, or posting a bond secured by property approved by the sheriff. The legislation would apply these same prohibitions on unsecured release to persons accused of misdemeanor offenses that are not arrests of a licensed driver.
